Terms of Service

**Effective date: August 10, 2026**

These Terms of Service (“Terms”) govern your access to and use of mittenmorningscoffee.com and any related content, features, products, and services offered by The Rushtons, LLC, doing business as Mitten Mornings Coffee Company (“Mitten Mornings,” “we,” “us,” or “our”). Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

By visiting the site, creating an account, or purchasing from us, you agree to these Terms and to the policies linked from them. If you do not agree, do not use the site or purchase our products.

## 1. Eligibility and account responsibility

You must be at least the age of majority in your place of residence, or use the site with the involvement and permission of a parent or legal guardian. You are responsible for providing accurate, current, and complete information and for safeguarding your account credentials. Notify us promptly if you believe your account has been used without authorization.

You may not use our products or site for an unlawful purpose or in violation of applicable law.

## 2. Products and descriptions

We make reasonable efforts to display product descriptions, colors, packaging, weights, availability, and images accurately. Screen settings, small-batch production, supplier updates, packaging changes, and photography may cause minor differences. Unless otherwise stated, coffee bags contain 12 ounces.

Product availability may change without notice. We may limit quantities, discontinue products, correct errors, or cancel an order when a product is unavailable or information was materially inaccurate. If we cancel a paid order, we will refund the canceled amount.

## 3. Coffee, flavor, and allergen information

Taste and aroma are subjective, and natural agricultural products can vary between lots. A product name, tasting note, or flavor description describes an intended sensory profile and is not a guarantee that every customer will perceive the product in the same way.

Ingredients and available allergen information are provided on the product page or package when applicable. Products may be produced or handled in facilities that process allergens. Customers with allergies, sensitivities, medical conditions, or dietary restrictions should contact us before purchasing and should consult an appropriate healthcare professional when needed. Our site does not provide medical advice.

## 4. Orders and acceptance

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean we have accepted the order. We may decline, limit, or cancel an order for reasons including suspected fraud, payment issues, pricing or inventory errors, resale activity, prohibited destinations, or product limitations.

You agree that the billing, payment, contact, and shipping information you provide is accurate and that you are authorized to use the selected payment method.

## 5. Prices, taxes, and payment

Prices are shown in the currency displayed at checkout and may change without notice. The price charged is the price displayed when the order is submitted, subject to correction of obvious errors as permitted by law. Taxes and shipping charges are calculated or disclosed at checkout. You authorize us and our payment providers to charge the total shown at checkout.

Discounts, promotional offers, and free-shipping thresholds are subject to their stated terms, availability, and expiration. Unless expressly allowed, offers cannot be combined, redeemed for cash, or applied retroactively.

## 6. Shipping and delivery

Processing and delivery are governed by our Shipping Policy, which is incorporated into these Terms. Coffee and merchandise may be fulfilled by different partners and may arrive in separate packages.

Delivery dates are estimates unless expressly guaranteed in writing. If we cannot ship within a promised time, we will provide any notice, cancellation option, or refund required by applicable law.

## 7. Returns, refunds, and cancellations

Returns, refunds, exchanges, damaged-order claims, and order cancellations are governed by our Refunds & Returns Policy, which is incorporated into these Terms. Coffee and consumable products are final sale for preference-based returns, but this does not limit remedies for products that arrive damaged, defective, incorrect, or materially different from their description.

## 8. Subscriptions

If subscriptions are offered, the price, discount, billing frequency, delivery frequency, renewal terms, and available management options shown at checkout form part of your purchase. Subscriptions renew and the saved payment method is charged at the disclosed interval until canceled.

You may manage or cancel an eligible subscription through your customer account or by contacting us before the next billing date. A cancellation stops future renewals; it does not automatically cancel or refund an order already billed or in fulfillment. Additional terms appear in our Subscription Policy and at checkout.

## 9. Customer communications

We may send transactional communications about orders, accounts, subscriptions, security, policy changes, or customer-service requests. If you opt in to marketing, you may unsubscribe from promotional email using the link in the message. Unsubscribing from marketing does not stop necessary transactional communications.

## 10. Reviews and user content

If you submit a review, photo, comment, suggestion, or other content, you represent that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights. You grant us a nonexclusive, worldwide, royalty-free license to host, reproduce, display, adapt, and use that content to operate, improve, and promote Mitten Mornings, subject to applicable law and our Privacy Policy.

We may moderate or remove user content that is unlawful, deceptive, abusive, infringing, irrelevant, contains personal information, or otherwise violates these Terms. We are not obligated to publish any submission.

## 11. Intellectual property

The site and its content—including the Mitten Mornings name, logos, designs, product names, photographs, graphics, articles, and written copy—are owned by or licensed to us and are protected by applicable intellectual-property laws. You may use the site for personal, noncommercial shopping and informational purposes only.

You may not copy, reproduce, modify, distribute, sell, scrape, frame, publish, or commercially exploit site content without our prior written permission, except as permitted by law.

## 12. Prohibited conduct

You may not:

- Use the site for unlawful, fraudulent, deceptive, harassing, or abusive activity
- Interfere with site security, operation, or another person’s use
- Introduce malware, harmful code, automated attacks, or excessive requests
- Attempt unauthorized access to accounts, systems, or data
- Scrape, harvest, or collect information except as permitted by law and our written instructions
- Impersonate another person or misrepresent your affiliation
- Infringe intellectual-property, privacy, publicity, or other rights
- Use site content or product listings to create a competing catalog or misleading marketplace listing

We may suspend or terminate access for conduct that violates these Terms.

## 13. Third-party services and links

The site may use or link to third-party services, including Shopify, payment processors, carriers, fulfillment providers, social platforms, and analytics or advertising providers. Their services may be governed by separate terms and privacy notices. We are not responsible for a third-party website or service that we do not control, except to the extent required by law.

## 14. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. By using the site, you acknowledge that information may be processed by Shopify and other service providers as described there.

## 15. Disclaimer of warranties

To the maximum extent permitted by law, the site and services are provided “as is” and “as available.” We do not warrant that the site will always be uninterrupted, secure, error-free, or free from harmful components. We do not disclaim warranties or consumer rights that cannot lawfully be excluded.

## 16. Limitation of liability

To the maximum extent permitted by law, Mitten Mornings and The Rushtons, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from use of the site or products.

To the maximum extent permitted by law, our total liability arising from a claim will not exceed the amount you paid to us for the product or order giving rise to that claim. These limitations do not apply where liability cannot lawfully be limited, including any liability that applicable law makes non-waivable.

## 17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless The Rushtons, LLC, Mitten Mornings, and their owners, personnel, service providers, and affiliates from third-party claims, losses, and reasonable expenses arising from your unlawful use of the site, your violation of these Terms, or your infringement of another person’s rights. This section does not require a consumer to indemnify us for our own unlawful conduct.

## 18. Governing law and venue

These Terms are governed by the laws of the State of Michigan and applicable federal law, without regard to conflict-of-law principles. Any dispute not subject to a non-waivable alternative forum will be brought in a court of competent jurisdiction serving Oakland County, Michigan. Nothing in this section deprives a consumer of protections or forums that cannot lawfully be waived.

## 19. Severability; waiver; assignment

If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, financing, reorganization, sale of assets, or similar business transaction, subject to applicable law.

## 20. Entire agreement and policy priority

These Terms and the policies linked from them form the agreement between you and us regarding the site and purchases. For a topic addressed by a specific policy, that policy controls over a conflicting general provision in these Terms. The Privacy Policy controls with respect to the collection, use, and disclosure of personal information.

## 21. Changes to these Terms

We may update these Terms to reflect changes in our services, operations, or legal obligations. We will post the revised Terms and update the effective date. Changes apply prospectively unless applicable law permits otherwise. If a material change requires notice or consent, we will provide it as required by law.
